■ 1. Allgemeines
Zwischen Artis Diversis – Johann A. G. Baloghy – Artworks Digital Gallery (nachfolgend ADG genannt) und Käufer gelten explizit und ausschließlich die nachfolgenden allgemeinen Geschäftsbedingungen in ihrer zum Zeitpunkt der Kaufabwicklung gültigen Fassung.
Eventuelle abweichende Wünsche/Bedingungen des Käufers werden explizit und ausschließlich nicht anerkannt.
Als Ausnahme hierfür gilt, wenn ADG diese Wünsche/Bedingungen des Käufers schriftlich zugestimmt hat.
■ 2. Kaufvertragsschluss und Kaufabwicklung
Als Vertragssprache steht dem Käufer die deutsche Sprache zur Verfügung.
Um es dem internationalen Käufer leichter zu machen, wurden zur Informationszwecke auch Übersetzungen wichtiger Inhalte auch in der Englische und französische Sprache bereitgestellt.
Es wird ausdrücklich darauf höflich hingewiesen, dass alle Kunstwerke als Einzel Verkaufsexemplare vorliegen und somit nur einmal verbindlich bestellt werden können!
Die unter dem Menu GALERIE | GALLERY Online Shop präsentierten Kunstwerkabbbildungen, stellen kein rechtlich bindendes Angebot, sondern die unverbindliche Online-Präsentation der Kunstwerke dar.
Geringfügige Abweichungen zwischen den in den Webseiten abgebildeten Kunstwerke und ausgelieferten Kunstwerke sind technisch bedingt möglich. Diese minore Abweichungen stellen jedoch kein Wertverlust dar, da letztendlich die physisch ausgelieferten Kunstwerke mit der höheren Priorität maßgebend sind!
Die vom Käufer über den [In den Warenkorb]-Button ausgewählten Kunstwerke werden im WARENKORB als Bestellungsübersicht zusammengefasst.
Die im WARENKORB angegebenen Preise sind die verbindlichen Endpreise inkl. MwSt. Die Versandkosten inkl. MwSt. werden gesondert aufgeführt und dem Kunstwerk-Endpreis jeweils hinzugerechnet.
Hier besteht die Möglichkeit, den Inhalt des Warenkorbs selektiv zu ändern, z. B. Positionen zu löschen und mit den [Warenkorb aktualisieren]-Button diese zu aktualisieren.
Weiterhin können hier nach der Eingabe von dem Käufer bereitgestellten Gutscheincodes über den [Gutschein Anwenden]-Button, bestimmte Ermäßigungen wie z. B. versandkostenfreier Verkauf durch Selbstabholung ausgelöst werden.
Im Bereich der Warenkorb-Summe wird die Versandkostenpauschale aufgrund der vom Käufer eingegebenen Versand-Adresse automatisch berechnet. Nach einer evtl. Adressenänderung muss diese mit den [Aktualisieren]-Button wieder aktualisiert werden.
Die Gesamtsumme stellt den verbindlichen Kaufpreis des Kunstwerkes inkl. MwSt., sowohl für das Kunstwerk wie auch für die Versandkosten nach derzeit gültigem deutschen und EU MwStR Mehrwertsteuerrecht, dar.
Mit dem Anklicken des [Weiter zu Kasse]-Buttons hat der Käufer die Möglichkeit, bei vorhandenem ADG Kundenkonto sich anzumelden und evtl. weitere Gutscheincodes einzugeben.
Falls der Käufer noch keinen ADG Kundenkonto hat, müssen die Pflichtfelder mit rotem Stern freiwillig jedoch verbindlich ausgefüllt werden!
Nach dem durch ein Hacken bestätigtes Lesen und Zustimmung der AGB-Inhalte kann der Käufer verbindlich die Zahlungsart mit direkter Weiterleitung an PayPal auslösen.
Diese Prozedur, die vom PayPal direkt betreut und abgewickelt wird, ermöglicht die Bezahlung über einem vorhandenen PayPal-Konto des Käufers oder alternativ über die Kreditkarte des Käufers, z. B. mit Visa-, Master-Karte etc.
Voraussetzung dafür sind jedoch die vorher richtig ausgefüllten Eingabefelder im „Rechnung & Versand“ – Bereich!
Unmittelbar nach der Bestellung und Bezahlung erhält der Käufer auf von ihm bereitgestellter E-Mail-Adresse eine verbindliche Bestell-, Vertrags- und Zahlungsbestätigung über die gekauften Kunstwerke. In einer weiteren E-Mail erhält der Käufer die Rechnung und die Kopie der zugestimmten AGB-Inhalte.
■ 3. Lieferung
Der Versand seitens ADG, startet in 1-4 Werktage und wird über DHL als Standardversand abgewickelt. Der DHL Versand dauert zusätzlich 1-3 Werktage für Deutschland.
Somit ist für Deutschland mit einer Lieferzeit von ca. 6-7 Werktage mindestens zu rechnen! Für das europäische Ausland gelten von DHL-Disposition evtl. abweichende Versanddauer.
Der DHL Versand beinhaltet auch inkl. die Sendungsverfolgung und inkl. die Haftung bis 500 EUR.
Der Käufer ist verpflichtet die verpackte Sendung bei Erhalt äußerlich zu prüfen und eine eventuelle Beschädigung der Verpackung, mit Bild dokumentiert, vom Frachtführer bestätigen zu lassen. Transportschäden sind unverzüglich beim zustellenden Transportunternehmen, DHL geltend zu machen.

■ 6. Urheberrecht
Mit dem Kauf eines Kunstwerkes erwirbt der Käufer ausschließlich nur das dingliche Eigentum an dem Kunstwerk. Keine weiteren Nutzungsrechte werden eingeräumt.
Alle Kunstwerke sind nach Autoren-Urheberrechte geschützt. Diese werden für Forschung, private Lehre und/oder Zwecke verkauft. Änderungen der verkauften Kunstwerke sind nicht gestattet.
Jegliche Reproduktion (Vervielfältigung), Verbreitung, Vermietung, öffentliche Zugänglichmachung oder sonstige analoge oder digitale Verwertung sind nicht gestattet, soweit dies nicht gesetzlich zugelassen ist.
Eine auszugsweise Wiederveröffentlichung der Kunstwerke wird nur nach einer schriftlichen Genehmigung mit Autoren- bzw. Quellenangaben versehen, gestattet.
■ 7. Austellungsort und Reinigung
Die Ausstellung des Kunstwerkes darf ausschließlich im Innenraum mit normalen Innenraumtemperaturen und normalen Innenraum Luftfeuchtigkeiten (z. B. Wohnzimmer) erfolgen. Die direkte Bestrahlung/Belichtung mit Kunst- oder Sonnenlicht ist unbedingt zu vermeiden!
Eventuell aufgelagerter Staub kann mit einer weichen und trockenen Flachbürste von der Oberflächen entfernt werden.

■ 1. General
Between Artis Diversis – Johann A. G. Baloghy – Artworks Digital Gallery (hereinafter referred to as ADG) and the buyer, the following general terms and conditions apply explicitly and exclusively in the version valid at the time of purchase.
Any deviating wishes / conditions of the buyer are explicitly and exclusively not recognized.
The exception to this is if ADG has agreed to these wishes / conditions of the buyer in writing.
■ 2. Conclusion of the purchase contract and purchase transaction
The German language is available to the buyer as the contract language.
To make it easier for international buyers, translations of important content have also been made available in English and French for information purposes.
It is expressly pointed out that all works of art are available as single sales copies and can therefore only be ordered once in a binding manner!
The under the menu GALLERY | GALLERY Online Shop presented images of art, do not represent a legally binding offer, but the non-binding online presentation of the works of art.
Slight deviations between the works of art shown on the website and delivered works of art are possible for technical reasons. However, these minor deviations do not represent a loss of value, since ultimately the physically delivered works of art with the higher priority are decisive!
The works of art selected by the buyer via the [Add to shopping cart] button are summarized in the SHOPPING BASKET as an order overview.
The prices stated in the BASKET are the binding final prices including VAT. The shipping costs including VAT are listed separately and added to the final price of the artwork.
Here you have the option to selectively change the contents of the shopping cart, e.g. B. To delete items and to update them with the [Update shopping cart] button.
Furthermore, after entering the voucher codes provided by the buyer via the [Apply voucher] button, certain discounts such as B. Free shipping can be triggered by collection.
In the area of the shopping cart total, the flat-rate shipping fee is calculated automatically based on the shipping address entered by the buyer. After a possible address change, this must be updated again with the [Update] button.
The total amount represents the binding purchase price of the work of art including VAT, both for the work of art and for the shipping costs according to the currently valid German and EU VAT law.
By clicking the [Proceed to checkout] button, the buyer has the option of logging in to an existing ADG customer account and possibly entering further voucher codes.
If the buyer does not yet have an ADG customer account, the mandatory fields with a red star must be filled out voluntarily, but binding!
After reading and agreeing to the terms and conditions, confirmed by ticking the box, the buyer can bindingly trigger the payment method with direct forwarding to PayPal.
This procedure, which is managed and handled directly by PayPal, enables payment to be made via an existing PayPal account of the buyer or alternatively via the buyer’s credit card, e.g. B. with Visa, Master card etc.
The prerequisite for this, however, is that the input fields in the “Invoice & Shipping” area have been correctly filled in beforehand!
Immediately after the order and payment, the buyer receives a binding order, contract and payment confirmation for the purchased works of art at the email address provided by him. In a further e-mail, the buyer receives the invoice and a copy of the agreed terms and conditions.
■ 3. Delivery
Shipping by ADG starts in 1-4 working days and is handled by DHL as standard shipping. DHL shipping also takes 1-3 working days for Germany.
Thus, a delivery time of at least 6-7 working days can be expected for Germany! For other European countries, DHL Disposition may have different shipping times.
DHL shipping also includes shipment tracking and liability up to EUR 500.
The buyer is obliged to check the outside of the packaged shipment upon receipt and to have any damage to the packaging documented with a picture by the carrier. Transport damage must be reported immediately to the delivering transport company, DHL.

With the purchase of a work of art, the buyer only acquires real ownership of the work of art. No further usage rights are granted.
All works of art are protected according to author’s copyrights. These are sold for research, private teaching and / or purposes. Changes to the sold works of art are not permitted.
Any reproduction (duplication), distribution, rental, making available to the public or any other analog or digital exploitation are not permitted unless permitted by law.
A republication of the works of art in extracts is only permitted after a written approval with author or source information.
■ 7. Place of exhibition and cleaning
The exhibition of the work of art may only take place in the interior with normal interior temperatures and normal interior humidity (e.g. living room). Direct irradiation / exposure to artificial or sunlight must be avoided at all costs!
Any accumulated dust can be removed from the surface with a soft, dry flat brush.

■ 2. Conclusion du contrat d’achat et transaction d’achat
La langue allemande est à la disposition de l’acheteur comme langue contractuelle.
Pour faciliter la tâche des acheteurs internationaux, des traductions de contenus importants ont également été mises à disposition en anglais et en français à titre informatif.
Il est expressément précisé que toutes les œuvres d’art sont disponibles en tant qu’exemplaires de vente individuels et ne peuvent donc être commandées qu’une seule fois de manière contraignante!
Le sous le menu GALERIE | La boutique en ligne GALERIE a présenté des images d’art, ne représente pas une offre juridiquement contraignante, mais la présentation en ligne non contraignante des œuvres d’art. De légers écarts entre les œuvres d’art présentées sur le site Web et les œuvres d’art livrées sont possibles pour des raisons techniques. Cependant, ces écarts mineurs ne représentent pas une perte de valeur, car en fin de compte, les œuvres d’art livrées physiquement avec la priorité la plus élevée sont décisives!
Les œuvres d’art sélectionnées par l’acheteur via le bouton [Ajouter au panier] sont récapitulées dans le PANIER D’ACHAT sous forme de récapitulatif de la commande.
Les prix indiqués dans le PANIER sont les prix définitifs obligatoires, TVA comprise, les frais de livraison, TVA comprise, sont indiqués séparément et ajoutés au prix final de l’œuvre.

Si l’acheteur ne possède pas encore de compte client ADG, les champs obligatoires avec une étoile rouge doivent être remplis volontairement, mais contraignant!
Après avoir lu et accepté les conditions générales, confirmées en cochant la case, l’acheteur peut déclencher de manière contraignante le mode de paiement avec transmission directe à PayPal.
Cette procédure, gérée et traitée directement par PayPal, permet d’effectuer le paiement via un compte PayPal existant de l’acheteur ou, alternativement, via la carte de crédit de l’acheteur, e. B. avec Visa, Master Card, etc.
La condition préalable pour cela est cependant que les champs de saisie dans la zone «Facture et expédition» aient été correctement remplis au préalable!
Immédiatement après la commande et le paiement, l’acheteur reçoit une commande ferme, un contrat et une confirmation de paiement pour les œuvres d’art achetées à l’adresse e-mail fournie par lui. Dans un autre e-mail, l’acheteur reçoit la facture et une copie des conditions générales convenues.
■ 3. Livraison
L’expédition par ADG commence dans 1 à 4 jours ouvrables et est gérée par DHL en tant qu’expédition standard. L’expédition DHL prend également 1 à 3 jours ouvrables pour l’Allemagne.
Ainsi, un délai de livraison d’au moins 6-7 jours ouvrables peut être prévu pour l’Allemagne! Pour les autres pays européens, DHL Disposition peut avoir des délais d’expédition différents.
L’expédition DHL comprend également le suivi des envois et la responsabilité jusqu’à 500 EUR.
L’acheteur est tenu de vérifier l’extérieur de l’envoi emballé à la réception et de faire documenter tout dommage à l’emballage avec une photo par le transporteur. Les dommages dus au transport doivent être signalés immédiatement à la société de transport de livraison, DHL.

Avec l’achat d’une œuvre d’art, l’acheteur n’acquiert que la propriété réelle de l’œuvre d’art. Aucun autre droit d’utilisation n’est accordé.
Toutes les œuvres d’art sont protégées selon les droits d’auteur de l’auteur. Ceux-ci sont vendus à des fins de recherche, d’enseignement privé et / ou à des fins. Les modifications des œuvres d’art vendues ne sont pas autorisées.
Toute reproduction (duplication), distribution, location, mise à disposition du public ou toute autre exploitation analogique ou numérique n’est autorisée que si la loi l’autorise.
Une republication des œuvres d’art sous forme d’extraits n’est autorisée qu’après accord écrit avec l’auteur ou les informations de la source.
■ 7. Lieu d’exposition et de nettoyage
L’exposition de l’œuvre d’art ne peut avoir lieu qu’à l’intérieur avec des températures intérieures normales et une humidité intérieure normale (par exemple dans le salon). L’irradiation directe / l’exposition à la lumière artificielle ou à la lumière du soleil doit être évitée à tout prix!
Toute poussière accumulée peut être enlevée de la surface avec une brosse plate douce et sèche.
